Lyss.Press Designs Terms and Conditions

By placing an order with Lyss.Press Designs, you agree to the following Terms and Conditions (referred to in this document as “Terms”).

DEFINITIONS

The items referred to in these Terms are defined as follows:

a) Lyss.Press Designs: I, the creator, operator, and publisher of Lyss.Press Designs and provider of Services.

b) Client: You, who have placed an order for a Service from Lyss.Press Designs.

c) Service or Services: The Services, including but not limited to book cover design, promotional graphic design, website design, and eBook formatting, provided by Lyss.Press Designs.

d) Deliverable or Deliverables: The digital files provided by Lyss.Press Designs to Client upon 100% payment by Client.

e) In-Progress Files: Watermarked or non-watermarked digital files provided by Lyss.Press Designs to Client for Client’s viewing during the Design Process prior to 100% payment by Client.

f) Design Process: Period of communication between Lyss.Press Designs and Client beginning with first email correspondence via email client or Lyss.Press Designs online form and ending with delivery of final files after 100% payment by Client.

PAYMENT

All payment will be conducted via PayPal invoices. No payments for Services will be accepted via PayPal’s Friends and Family feature but only through invoices. After Client and Lyss.Press Designs have agreed on a final price via email, Lyss.Press Designs will issue a PayPal invoice.

For all custom design Services, Client must pay a minimum of 50% of the invoice before Lyss.Press Designs can begin working on the order. This minimum 50% payment is nonrefundable. At any point in the Design Process, if the Client fails to respond to Lyss.Press Designs via email for a period of 30 days, the Service is considered rendered and Lyss.Press Designs will keep the initial payment.

For eBook formatting and premade book covers, Client must pay the invoice in full before Lyss.Press Designs can begin working on the order. If the Client has failed to pay the invoice in full after 7 days, the order will be cancelled, and any premade graphics will go back up for sale on the Lyss.Press Designs website.

After the PayPal invoice is issued, the price cannot be lowered for any reason. Lyss.Press Designs can increase the price if it is to cover additional revisions over the maximum amount as outlined in the “Design Process” section of these Terms, and Lyss.Press Designs will always discuss an increase in price with Client. Client is not obligated to pay an increased price unless Client wishes to purchase additional revisions.

DESIGN PROCESS

The Design Process is composed of the following steps.

For Custom Graphic Design Services:

  1. Client contacts Lyss.Press Designs via email or via an order form on the Lyss.Press Designs website.
  2. Lyss.Press Designs and Client communicate about Client’s needs and decide on a final price for Services.
  3. Lyss.Press Designs issues a PayPal invoice.
  4. Client pays a minimum 50% of the invoice.
  5. If Lyss.Press Designs has not already done so in step 2, Lyss.Press Designs asks a series of questions of Client, and Client answers those questions. Lyss.Press Designs may ask additional questions throughout the Design Process.
  6. Lyss.Press Designs provides a minimum of one design concept in the form of an In-Progress File.
  7. Client provides feedback on In-Progress File(s), and Lyss.Press modifies In-Progress File(s) or creates new In-Progress File(s) accordingly.
  8. Steps 6 and 7 compose a Revision. Lyss.Press Designs will offer a maximum number of 10 revisions on all graphic design orders. If after 10 revisions, the Client has not yet approved a final design, Lyss.Press Designs will inform the Client that they have received the maximum number of revisions and that each additional revision will incur a 5% increase to the final price.
  9. Upon 100% payment of the final invoice, Lyss.Press Designs provides Client with Deliverables. Specifics of Deliverables are outlined in the “Deliverables” section of these Terms.

For Custom Website Design Services:

  1. Client contacts Lyss.Press Designs via email or via an order form on the Lyss.Press Designs website.
  2. Lyss.Press Designs and Client communicate about Client’s needs and decide on a final price for Services.
  3. Lyss.Press Designs issues a PayPal invoice.
  4. Client pays a minimum 50% of the invoice.
  5. If Lyss.Press Designs has not already done so in step 2, Lyss.Press Designs asks a series of questions of Client, and Client answers those questions. Lyss.Press Designs may ask additional questions throughout the Design Process.
  6. Lyss.Press Designs provides a design concept in the form of an in-progress Elementor template.
  7. Client provides feedback on the in-progress Elementor template, and Lyss.Press modifies the in-progress Elementor template accordingly.
  8. Steps 6 and 7 compose a Revision. Lyss.Press Designs offers unlimited revisions for website design orders but reserves the right to cancel an order at any time. In the event that Lyss.Press Designs cancels an order, Lyss.Press Designs will provide a refund of the initial deposit.
  9. Upon 100% payment of the final invoice, Lyss.Press Designs provides Client with Deliverables. Specifics of Deliverables are outlined in the “Deliverables” section of these Terms.

For eBook Formatting Services:

  1. Client contacts Lyss.Press Designs via email or via an order form on the Lyss.Press Designs website.
  2. Lyss.Press Designs and Client communicate about Client’s needs and decide on a final price for Services.
  3. Lyss.Press Designs issues a PayPal invoice.
  4. Client pays the invoice in full.
  5. If Lyss.Press Designs has not already done so in step 2, Lyss.Press Designs asks a series of questions of Client, and Client answers those questions. Lyss.Press Designs may ask additional questions throughout the Design Process. Client provides all text to be included in the eBook files in .DOC, .DOCX, .ODT, or .RTF format as well as an eBook cover file.
  6. Lyss.Press Designs prepares the formatted eBook files and delivers them to Client.
  7. Client may request changes. Lyss.Press Designs carries out those changes.
  8. Steps 6 and 7 compose a Revision. Lyss.Press Designs offers a maximum of 4 revisions on eBook formatting files. Client may purchase further revisions at an additional cost of 10% of the overall price per revision, and Client must pay for the additional revisions before Lyss.Press Designs delivers the revised files. Client is under no obligation to purchase additional revisions.

For Premade Book Cover Services:

  1. Client expresses desire to purchase a specific premade book cover via the order form on the Lyss.Press Designs website.
  2. Lyss.Press Designs issues a PayPal invoice for the price of the premade cover.
  3. Client pays the invoice in full.
  4. Lyss.Press Designs replaces the placeholder text in the premade cover files with Client’s desired text.
  5. Client provides feedback on the inserted text. Minor revisions to text ONLY are allowed at this point. Lyss.Press Designs will not modify images or typefaces used in the premade designs but may change position of text, add or remove taglines, or change the color of text.
  6. Lyss.Press Designs provides Client with final Deliverables. Specifics of Deliverables are outlined in the “Deliverables” section of these Terms.

Lyss.Press Designs reserves the right to cancel an order at any time. If Lyss.Press Designs cancels an order, Lyss.Press Designs will provide a refund of the initial deposit.

DELIVERABLES

For each Service, the Deliverables are as follows.

For Custom Graphic Design Services:

For digital designs, a series of flattened .JPG files in various applicable dimensions; for print designs, a flattened, print-ready .PDF file

For Custom Website Design Services

Website design installed and live on Client’s WordPress website

For eBook Formatting Services:

eBook files in .MOBI, .EPUB, and .PDF formats for a total of 3 files

For Premade Book Cover Services:

For eBook covers, a series of flattened .JPG image files; for print covers, a flattened, print-ready .PDF file

Lyss.Press Designs will NOT provide any .PSD files or other types of layered files. For eBook formatting, Lyss.Press Designs will NOT provide any Vellum files. If Client needs minor changes to final Deliverables, Lyss.Press Designs will provide updated files free of charge. Lyss.Press Designs reserves the right to refuse free revisions if the changes requested are not minor.

REFUND POLICY

Lyss.Press Designs does not issue refunds except in the event of Lyss.Press Designs cancelling an order. If Lyss.Press Designs cancels an order at any point before delivering final files, Lyss.Press Designs will refund all payments pertaining to that order to Client via PayPal.

RIGHTS

Upon delivery of final Deliverables, Lyss.Press Designs grants exclusive use of Deliverables by Client in accordance with the licenses of any stock photography, fonts, and any other digital assets incorporated into the final Deliverables. Client does NOT have the right to sell Deliverables to a third party.

Lyss.Press Designs retains the right to display Deliverables on the Lyss.Press Designs website as examples of Services rendered. Upon written request from Client, Lyss.Press Designs will delay the display of book cover files on the Lyss.Press Designs website in order not to interfere with cover reveals. Regardless of cover reveals, if 30 days have passed after delivery of Deliverables to Client, Lyss.Press Designs has the right to display the Deliverables on the Lyss.Press Designs website.
